Ellijay Police Shut Down Smoke On The Mountain

District Attorney Joe Hendricks and Ellijay Police Chief Larry Callahan release the following statement:

In an ongoing and cooperative effort to prevent the the illegal distribution of synthetic marijuana, the Ellijay Police Department, Appalachian Circuit District Attorneys Office and Gilmer Sheriff’s Office began monitoring merchants known engage in the sale these substances. After Senate Bill 370, which was signed into law on March 27, 2012, banned the chemicals that had been previously been legal these agencies notified merchants that further possession and distribution of these substances would result in prosecution for violation of the Georgia Controlled Substances Act.
Ellijay police on 04/14/2012 arrested Jason Allen an operator of the business called Smoke on the Mountain for Disorderly Conduct and possession of marijuana less than one ounce. Ellijay Police Officers seized several packets of suspected synthetic drugs. The GBI Crime Lab issued a report that reflected that some of the items submitted tested positive for Schedule 1 Narcotics. In addition, law enforcement had been receiving several complaints from civilians regarding this place that their children were buying possible synthetic drugs and the items were making them sick and or “crazy”.

On June 5, 2012 the Ellijay Police Department obtained arrest warrants for Jason Allen as well as his wife and the owner of Smoke on the Mountain, Kristin Allen for Possession With Intent to Distribute Schedule One Drugs. District Attorney’s Investigators obtained a search warrant for all banned substances contained in the establishment. 221 packs of suspected banned substances were seized as well as $7,735 in cash as proceeds from the sale of the substances.

The case will likely be presented to the Gilmer County Grand Jury during the week of June 25.
